These terms and conditions shall apply to your purchase of tickets for the Oaktree Garden Centre Christmas Grotto.

Please read these terms and conditions carefully, particularly Section 3 regarding our cancellation policy and Section 5 regarding Data Protection. 1. OAKTREE CHRISTMAS GROTTO

1.1 The Oaktree Christmas Grotto operates at Oaktree Garden Centre & Nursery, Brock Hill, Bracknell Road, Bracknell, Berkshire RG42 6LH.

1.2 Admission to the Oaktree Christmas Grotto is only accepted upon receipt of a valid ticket purchased in store or online through www.oaktreegardencentre.com, www.oaktreegardencentre.co.uk and the Oaktree Garden Centre & Nursery Facebook page.

1.3 Your ticket must be presented in printed form or viewable on a mobile device. Oaktree Garden Centre & Nursery reserve the right to request proof of identity before allowing admission to the Oaktree Christmas Grotto.

1.4 You must arrive at least TEN (10) minutes in advance of your allocated time slot. We will use our reasonable endeavours to admit latecomers when a suitable break in the event arises, but late admission cannot be guaranteed and Oaktree Garden Centre & Nursery reserve the right to refuse admission for any latecomers.

1.5 You shall be responsible at all times for ensuring the correct and safe supervision of all accompanying children below the age of fourteen (14) years.

2. PURCHASING YOUR TICKETS

2.1 Tickets to the Oaktree Christmas Grotto are available to purchase in store or online through www.oaktreegardencentre.com, www.oaktreegardencentre.co.uk, https://oaktreegardencentre.digitickets.co.uk/tickets and the Oaktree Garden Centre & Nursery Facebook page and are subject to availability.

2.2 Payments for tickets online shall be made using the online payment facility which is provided by Sagepay. We do not store your payment card details.

2.3 For certain dates, there may be a restriction on the number of tickets available per family.

2.4 Your ticket is only valid for the date and time specified on your ticket.

2.5 Your ticket remains the property of Oaktree Garden Centre & Nursery and is a personal revocable licence which may be withdrawn and admission refused at any time at our sole discretion upon refunding the ticket purchase price.

2.6 Unlawful resale (or attempted unlawful resale) of a ticket will result in the cancellation of that ticket without refund or other compensation.

2.7 We will not be responsible for any tickets that are lost or stolen. You will be responsible to ensure that you have a valid ticket ready to be inspected upon your arrival at the Oaktree Christmas Grotto.

3. CANCELLATION - IMPORTANT

3.1 Tickets to the Oaktree Christmas Grotto are non-refundable.

3.2 You may change your allocated time slot up to seven (7) days prior to your allocated time slot by notifying us by any of the following means:

a)      By telephone: 01344 890 667 (Opening hours Monday to Saturday 8am to 6pm and Sunday 10am to 4pm excluding Christmas Day, Boxing Day, New Years Day and Easter Sunday) calls are charged at Your UK standard providers rate.

b)     Visiting our store: Oaktree Garden Centre & Nursery, Brock Hill, Bracknell Road, Bracknell, Berkshire RG42 6LH.

Due to limited availability we cannot always guarantee an alternative time slot if you are unable to attend your original allocated time slot.

3.3 Oaktree Garden Centre & Nursery may cancel or reschedule your visit to the Oaktree Christmas Grotto at any time at our absolute discretion. A full refund will be provided in the event that an alternative date cannot be made by you or Oaktree Garden Centre & Nursery.

3.4 Oaktree Garden Centre accept no responsibility for any cancelled visits due to any fault of the customer or any reasons outside of Oaktree Garden Centre’s control.

4. PHOTOGRAPHY

4.1 You are permitted to take your own photographs during your visit at the Oaktree Christmas Grotto on the strict condition that all photographs consist of your family members only and not of any other guest at the Oaktree Christmas Grotto without their express permission. It is important that other guest’s privacy is respected at all times during your visit.

4.2 By purchasing a ticket, ticking the ‘I agree to the terms and conditions and the Privacy and Cookie Policy’ box and visiting the Oaktree Christmas Grotto, you are confirming that you consent to the taking, retaining and use of any photographs taken during your visit to the Oaktree Christmas Grotto. We may, for example, include photographs of your visit on the Oaktree Garden Centre & Nursery social media channels and any public relations materials. Should you not wish for us to take photographs of you or your family, you must make it known to the Oaktree Garden Centre and Nursery staff upon arrival.

5. YOUR PRIVACY

5.1 By providing your personal information to us when you purchase your ticket, you consent to us processing your data in accordance with these terms and our privacy policy which can be accessed via the following link: http://www.oaktreegardencentre.com/privacy-policy.

5.2 The personal information you provide to us when you purchase your ticket will be jointly held by us and Digiticket, a third party supplier that we use to provide the online platform your tickets are booked through. 5.3 Your personal information is collected and stored in accordance with the Data Protection Act 2018, The General Data Protection Regulation and all other relevant data protection legislation that may apply. Both Oaktree Garden Centre & Nursery and Digiticket are registered data controllers with the Information Commissioners Office.

6. LIABILITY

6.1 Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, or the negligence of our employees or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

6.2 However, Oaktree Garden Centre will have no liability for any damage to property or personal injury arising as a result of the negligence of any other customers or visitors to the Christmas Grotto.

6.3 We shall under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any legal costs or any indirect, special or consequential loss arising under or in connection with your entry and participation in the Oaktree Christmas Grotto.

6.4 Our liability to you relating to the services provided shall be limited to the cost of any tickets purchased by you.

7. GOVERNING LAW

7.1 This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be referred to an independent arbitrator and governed by and construed in accordance with English law.

7.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that cannot be resolved by an independent arbitrator.
